DATED:
03rd NOVEMBER, 2025.
PC:- 1.
Heard Mr. Rahul S. Kate, learned counsel appearing for the Petitioner. Also perused the statements made in the Writ Petition. 2.
It appears that the Petitioner had availed two loan facilities from the Respondent No.4, one for an amount of Rs.1,44,80,000/- an other, amounting to Rs.50,00,000/-. However, the Petitioner had defaulted in repaying the loan amount, as a result of which, proceedings were initiated against the Petitioner-society under the provisions of Section 101 of the Maharashtra Co-operative Societies Act, 1960.
3.
The Petitioner has approached this Court by filing this Writ Petition, primarily contending that it wants to repay the entire amount to the Respondent No.4. However, due to want of Digitally signed by PRIYA RAJESH SOPARKAR Date:
2025.11.03 18:21:50 +0530 PRIYA RAJESH SOPARKAR 03rd November, 2025.
21 WP 13798-25-C.DOC accurate and authentic information, as to the actual outstanding dues as on date, no action could be taken in the matter. 4.
Ms. Tanu Bhatia, learned AGP appearing for the Respondents Nos.1 and 3 submits that she does not have any instructions in the matter.
5.
After hearing the arguments advanced at the Bar, we are of the view that instead of keeping this Writ Petition pending, appropriate course of action would be to direct the Respondent No.2 to furnish an updated account statement to the Petitioner. 6.
We, therefore, dispose of the Writ Petition by providing that the Respondent No.4 may furnish updated account statement to the Writ Petitioner, indicating the total amount due and payable by the Petitioner as on 31st October, 2025. The statement be issued within two weeks from the date of receipt of this order. After receipt of the statement, it would be open for the Petitioner to repay the outstanding dues, in any manner, mutually agreed to by and between the Petitioner and the Respondent No.4. 7.
With the above observations, the Writ Petition stands disposed of.
