... Respondents ...

Mr.Jagdish G. Aradwad (Reddy) with Ms.Ashwini Jadhav for Respondent Nos. 1 and 2- Corporation.

CORAM :

RAVINDRA V. GHUGE & ABHAY J. MANTRI, JJ.

DATE : FEBRUARY 11, 2026 P.C:

1.

The Petitioners' representation dated 13.06.2025, seeking permission for carrying out repairs, has been pending with the Corporation for the past seven months and has not been decided. The Petitioners are, therefore, compelled to approach this Court seeking issuance of a Writ of Mandamus directing the Corporation to decide the said pending application. The Petitioners further pray that the Corporation should proceed with the notice dated 22.06.2018 issued by it, as the developer has disconnected the Petitioners' water supply and the Petitioners have been without water supply for the last eight years. This issue also needs to be decided by the Corporation.

The learned Advocate for the Corporation has taken the usual stand that instructions will have to be taken from the Corporation as to when they would oblige the Petitioners by deciding their application. This cannot be countenanced.

3.

In view of the above, the Writ Petition is disposed off with a direction to the Corporation to follow the due procedure laid down in law, consider the said representation, and pass a reasoned order, within a period of 45 days from today.

4.

So also, the pending issue regarding the notice issued to the developer for allegedly illegally disconnecting the water supply, shall also be taken to its logical end by following the due procedure laid down in law, within a period of 60 days from today.
