____________________________________________________________ CORAM : M.S. Sonak & Advait M. Sethna, JJ.
DATED : 19 November 2025 P.C.:- 1.

2.
Ms. Vyas, learned Addl. G.P. along with Aditya Deolekar, learned AGP appeared for the State.
3.
On 11th November 2025 we were constrained to make the following order :- "P.C.:-
1. None for the Petitioner.
2. In order to grant the Petitioner an additional opportunity, we post this matter on 19 November 2025 under the caption 'For Dismissal'.
20-WP-14002-2025 (C).DOCX
3. Even otherwise the challenge in this petition is to the assessment order which is appealable." 4.
Today, the same position continues. Ms. Vyas points out that the order impugned in this petition is appealable. 5.
Therefore, we dismiss this petition for non prosecution. 6.
However, the dismissal of this petition on the ground of non prosecution will not bar the petitioner from exploring the possibility of availing the alternate remedy of appeal. This is because we have not decided the matter on merits.
7.
The petition is disposed of in the above terms. No costs. (Advait M. Sethna, J) (M. S. Sonak, J.)
