Heard learned Advocate for petitioner.

The order impugned in the petition directs the petitioner to deposit statutory amount pending the appeal under the provisions of SARFAESI Act. Petitioner has failed to deposit the same and, therefore, the appeal came to be dismissed by the appellate Court. Today, the petitioner makes a statement that he is ready and willing to deposit the statutory

10_WP_14059_2025 amount on or before 09.02.2026.

The learned Advocate appearing for respondent Bank opposes by stating that the impugned order has already taken effect and the statutory appeal has already been dismissed. In light of above he prays that no additional time be given to petitioner.

Taking into consideration the fact that the statutory appeal has not been decided on merits and it has been decided only for depositing 25% cost amount under the provisions of SARFAESSI Act, we are ready to give a chance to deposit the said amount.

Petitioner is directed to deposit the amount as assured and produce the receipt to that effect on record on or before 09.02.2026. Place the matter for further orders on 10.02.2026. ( HITEN S. VENEGAVKAR, J. ) ( SMT. VIBHA KANKANWADI, J. ) agd
