After hearing the submissions on behalf of the petitioner and when disinclination is shown to grant prayer clause "C", learned advocate for the petitioner submits that he will not press the said relief. Accordingly, the petition stands dismissed for prayer clause "C". 3.
Issue notice to respondents No.1 to 4 in respect of prayer clauses "A" and "B". Learned AGP waives service of notice for respondent No.3. 4.

In the meantime, no coercive action shall be taken in respect of the closure of the BOT pay and use unit between 22:30 Hrs and 06:00 Hrs daily. However, we make it clear that we have not given any direction in respect of the payment of the license fee, and in case of failure on the part of the petitioner to pay the same, necessary action can be taken.
