Sangeeta Arun Boinwad v. The State Of Maharashtra Through Its Principal Secretary And Others
1 1052 wp 14150-25
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 1052 WRIT PETITION NO. 14150 OF 2025 SANGEETA ARUN BOINWAD
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS PRINCIPAL SECRETARY AND OTHERS ...
Mr. Solanke Shrikrashna B., Advocate for the Petitioner Mr. P. K. Lakhotiya, AGP for Respondent-State ....
CORAM : SANDIPKUMAR C. MORE AND ABASAHEB D. SHINDE, JJ.
DATED : 28/01/2026 P. C. :
1.
Heard.
2.
By the present writ petition, the petitioner, who is the wife of the original claimant, takes an exception to the order dated 20/08/2025 passed by the Respondent - Scrutiny Committee, whereby the tribe claim of the petitioner of belonging to the "KoliMahadev" Scheduled Tribe, has been invalidated. 3.
Learned counsel for the petitioner submits that the genealogy submitted before the Scrutiny Committee shows that Vitthal is the brother of the petitioner's husband, whose daughter, namely Srusti, whose tribe claim was invalidated had approached this Court by way of Writ Petition No. 10982 of 2025. This Court, by an order dated 18/09/2025, allowed the said writ petition by setting aside the order of invalidation of her tribe claim.
2 1052 wp 14150-25 4.
Per contra, learned AGP fairly concedes that the said Srusti, in whose favour this Court has granted validity, is the real niece of the petitioner's husband.
5.
Since the relationship of the petitioner's husband with the validity holder, namely Srusti Vitthal Boinwad, is not in dispute, we find that the present writ petition deserves to be allowed by setting aside the impugned order. In view of the same, we pass the following order.
ORDER
I) The impugned order dated 28/08/2025 passed by Respondent No.2 - Scrutiny Committee, whereby the tribe claim of the petitioner, belonging to the "Koli-Mahadev" Scheduled Tribe, was invalidated, is hereby quashed and set aside.
II.
The Respondent - Scrutiny Committee is directed to issue a validity certificate in the name of the husband of the petitioner, confirming his belonging to the "Koli-Mahadev" Scheduled Tribe. III.
With these directions, the writ petition stands disposed of.
