The petitioner is a workman, who had approached the Industrial Court by filing a complaint, alleging unfair labour practices against respondents-employers. The complaint was partly allowed and the respondents-employers were directed to reinstate the petitioner and a further direction was issued to pay back-wages from 12.11.2024.

The petitioner is aggrieved by the fact that the back-wages have not been granted from an earlier date. According to the petitioner, he is entitled to back-wages from 19.08.2020 i.e. the date on which fitness certificate was issued by a medical officer and a copy of the same was placed before the Industrial Court. It is also stated that till date the petitioner has not been reinstated. 3.

To the extent that the petitioner is aggrieved by the impugned order, as indicated hereinabove, issue notice for final disposal, returnable on 09.01.2026.

Additionally, the petitioner is permitted to serve the respondents by way of private service and file an affidavit of service before the next date of listing.
