IN THE HIGH COURT OF JUDICATURE AT BOMBAY

SUNNY ANKUSHRAO THOTE CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 14297 OF 2025 Parvati Shankar Mhatre & Ors.

...Petitioners

Versus

The State of Maharashtra & Ors.

...Respondents

None for the Petitioners Ms. Pooja Patil, AGP for Respondent Nos.1 to 5/State. Mr. Padmanabh D. Pise i/by P. Padmanabh & Associates, Advocate for Respondent No.6.

CORAM : RAVINDRA V. GHUGE & ABHAY J. MANTRI, JJ.

DATE : 6th MARCH, 2026 P.C. :- 1.

None present for the Petitioners, either in the Court hall or through the video conferencing mode.

2.

The Petitioners pray that the Order and Judgment dated 6th August, 2025, delivered by the Additional Divisional Commissioner, Konkan Division under the Maharashtra Land Revenue Code, 1966 ('MLR Code, 1966'), should not be

implemented and the names of the Petitioners should be entered in the revenue records. The Revenue Department be directed not to effect changes in the mutation entries during the pendency of the Appeal under the MLR Code, 1966.

3.

Apparently, these two prayers cannot be considered in the Writ jurisdiction of this Court, since the Petitioners have a remedy under Section 247 of the MLR Code, 1966 read with Schedule E, whereby they can assail the Order and Judgment of the Additional Divisional Commissioner before an appropriate Authority.

4.

The learned Advocate representing Respondent No.6, an agriculturist, in whose favour the Order and Judgment dated 6th August, 2025 has been delivered, submits on instructions that the Petitioners have already availed of a remedy before the Minister and the proceedings are now closed for Judgment.

5.

The learned AGP submits, on instructions, that the order of the Additional Divisional Commissioner dated 6th August, 2025, has already been effected on 19th August, 2025.

6.

In view of the above, this Writ Petition need not be entertained. As such, this Writ Petition is disposed off. (ABHAY J. MANTRI, J.) (RAVINDRA V. GHUGE, J.)
