IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 917 WRIT PETITION NO.14308 OF 2025 DAYANAND BHIMRAO SALVE AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Mr. R.B. Magare, Advocate for petitioners Mr. S.B. Narwade, AGP for respondent Nos.1 to 5 ...

CORAM :

SMT. VIBHA KANKANWADI & HITEN S. VENEGAVKAR, JJ.

DATE :

22nd JANUARY, 2026 ORDER :

.

Learned Advocate for petitioners is absent. On the last date also nobody was present. We have gone through the petition. Petition has been filed for following reliefs :

"(A) Issue a writ of certiorari or any other appropriate writ, order or direction in the nature thereof, quashing and setting aside the arbitrary and illegal action of deletion of the petitioner's names from the revenue records and/or arbitrary reduction of their land areas as arbitrary, illegal, and quash any such action taken without notice or due process.

917_WP_14308_2025 (B) Issue a writ of Mandamus or any other appropriate writ, order or direction, directing the respondent authorities to restore the names of all the petitioners in the 7/12 record of the said land with full original possession of 80 R (2 Acres) each, based on their long standing possession, cultivation and eligibility under applicable Government Resolutions.

(C) Direct the respondents not to interfere with the petitioner's peaceful possession, cultivation and enjoyment of the said lands to the extent of 80 R (2 Acres) each and restrain them from undertaking any coercive steps, including eviction, till the regularization proceedings are concluded in accordance with law."

We take objection in respect of maintainability of the writ. If at all the petitioners had any objection in respect of revenue entry, they were at liberty to approach the higher revenue officer of appellate jurisdiction. Further, it appears that petitioners are the encroachers. Under such circumstance, the writ petition itself is not maintainable. Hence, writ petition stands dismissed.
