There is no dispute that Petitioner No. 1 is a lady who cohabited with the deceased employee, who was already married and the marriage subsisted. Petitioner No. 2 is the youngest son born out of the relationship which Petitioner No.1 had with the deceased employee. In all, four children were born. Out of which, two are married daughters and two are sons who are 35 and 31 years of age, respectively. The first wife is childless. Needless to state, the lady (Petitioner no.1) had no right to pension.

The learned Advocate for Respondent Nos. 1 and 2, Mumbai Port Trust, submits that the pension was paid to the youngest son i.e. Petitioner No. 2, until he became18 years of age. He has also got married and is not entitled to the pension.

The learned Advocate for the Petitioners submits that the Petitioners desire to withdraw this Petition. 4.
In view of the above, this Writ Petition is disposed off as withdrawn, on instructions.
