DATE : 24th March 2026 P.C.:- 1) This Petition was heard on several occasions. With a view to bring an amicable settlement, this Court has spent substantial time in mediation. However, the mediation is unsuccessful. 2) Today, the Petitioner has addressed a letter to his Advocate on record requesting him to withdraw the Petition to enable him to file a Revision Application under Section 154(2A) of the Maharashtra Cooperative Societies Act, 1960. The Petitioner is personally present in the Court and reiterates that he has instructed his Advocate to withdraw the Petition.

sns 5-wp-14615-2025.doc 3) In view of the above, we permit the Petition to be withdrawn with liberty to challenge the Recovery Certificate dated 17th March, 2011, issued by Respondent No.2 before the appropriate Authority. 3.1) It is needless to mention that, the said challenge will be subject to the provisions of Limitation Act and all other prevalent laws and Rules thereof.

3.2) It is made clear that, grant of leave by this Court will not allure to the benefit of the Petitioner contrary to the law of Limitation. 4) The amount of Rs.13,23,949/- deposited by the Petitioner in the Registry of this Court and as recorded in Order dated 9th March, 2026, be transfered to the account of Respondent No.4-Bank within a period of one week from the date of uploading of the present Order on the official website of the High Court of Bombay. After the deposit of the said amount, the Petitioner will get set off of the said amount from the payment of total decretal amount to the Respondent No.4-Bank.
