Heard learned counsel for the Petitioner. We have also heard learned AGP appearing for the State.

The Petitioner is seeking direction to the Respondents to enter Digitally signed by LATA SUNIL PANJWANI Date:

2026.01.07 11:57:10 +0530 the Petitioner's name in the revenue records on the basis of the LATA SUNIL PANJWANI registered sale deed dated 11th May 2017. The facts in brief are that:

On 28th November 2016, the Collector, Thane gave permission for sale of tribal land at Kasara, Tal. Shahapur bearing Survey no.139/a/2 admeasuring 1 hecter 53 Are. Accordingly, sale deed dated 11th May 2017 was executed between the Petitioner and owner in respect of tribal land. The consideration amount was paid to the transferrer. An application was filed before the Tahsildar to verify whether the transferrer has received the consideration

LSP 2 39 wp 14669.25.doc amount. Notices were sent to the transferrer by the Tahsildar. The transferrer died on 24th July 2024. The Tahsildar, therefore issued a notice to the heirs of the transferrer to appear in the proceedings. The heirs of the deceased Sakru Aagiwale did not appear. Report was submitted by the Tahsildar on 25th September 2025 to the Collector. The Petitioner made a representation to the Collector on 29th September 2025 for entering the name of the Petitioner in the revenue records.

From the materials on record it does appear that the permission was granted for transfer of the tribal land subject to certain terms and conditions. The Petitioner submits that all the conditions have been fulfilled. Since an application has been made by the Petitioner to the Tahsildar for entering the name of the Petitioner in the revenue records, we direct the Collector to decide the application dated 29th September 2025 which is at page-106 of the paper-book on its own merits and in accordance with law expeditiously and in any event within a period of 10 weeks from the date of communication of this order.

The Petitioner to appear before the Collector along with copy of this order on 20th January 2026 at 11.00 a.m. 5.

The Writ Petition is disposed of.
