The learned Counsel for the petitioner submits that his father possesses substantial ancestral properties, from the income of which he is able to maintain himself. The father also owns a house property. He further submits that, in terms of the directions issued under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, he has been duly paying maintenance. In this factual situation, it is unwarranted to allege that he is not taking care of his parents, as there has been no violation of any condition. He further submits that, in view of the above, there is no need for revocation of Gift Deed No. 5093 dated 18/07/2019. He also submits that there is a pending suit between the brothers, and there are attempts of undue harassment by the respondents. He assures that he will continue to pay maintenance as directed by the authorities. 3.

In view of the above, issue notice to the respondents, returnable on Page 1 of

31 WP 14689-2025 14/01/2026.

Till the next date, there shall be an ad interim stay to the extent of Clause 2 of the order dated 12/09/2025, passed by the Sub Divisional Officer and Senior Citizens Maintenance Tribunal, Parbhani, and upheld by the Appellate Court.
