These petitions have been filed by the petitioners pressing for the limited relief of a direction to the Debt Recovery Appellate Tribunal, Mumbai (DRAT), to dispose of pending appeals expeditiously. 2.

At the point in time when these writ petitions were filed, the DRAT did not have a Chairperson, as a consequence of which, hearings on appeals

were being adjourned from time to time.

It is an admitted position that now the vacancy has been filled and DRAT is available for hearing and disposing of the pending appeals. 4.

The Respondents in both the petitions are represented by counsel who has joined the hearing through video conferencing. He seeks time to file vakalatnama and reply in these petitions.

But, considering the limited relief being pressed on behalf of the petitioners, we are inclined to dispose of the writ petitions with appropriate directions.

We are of the opinion that a direction for expeditious disposal of pending appeals is in the interest of all the concerned parties. We are further informed that the next date of hearing in the appeals before the DRAT is 29th April 2026.

In that view of the matter, the writ petitions are disposed of by issuing the following directions :

(a) The respondents in both these writ petitions shall file their reply affidavits in the pending appeals i.e. Appeal No. 74 of 2024 and 75 of 2024, on or before 24th April 2026.

(b) Rejoinder affidavit, if any, on behalf of the petitioners shall be filed in

the pending appeals before the DRAT on or before 28th April 2026. 8.

The DRAT will take up the aforesaid pending appeals for hearing on 29th April 2026 and dispose of both the appeals at the earliest and in any case on or before 31st May 2026.

The writ petitions are disposed of. Pending applications, if any, also stand disposed of. It is made clear that this Court has not expressed any opinion on the merits of the matter.

The learned counsel having instructions to appear on behalf of the respondents in these writ petitions is permitted to file his vakalatnama within one week from today.
