The petitioners seek to challenge the notification dated 21st August 2025 to the extent that the deemed date as 1st July 2025 to be considered as the date for valid voters list. This prayer has been made in the context of the order of rejection dated 2nd July 2025 by which the application moved by the petitioners seeking transfer of their names in the voters list of village Balapur to village Arvi has been rejected.

The learned counsel for the petitioners refers to the application made vide Exhibit-B and submits that the application so moved by the petitioners was rejected after the petitioners submitted the necessary documents.

However, as we find on a glance at page no. 66 of the paperbook, it is disclosed that the application submitted by the petitioners on 25th June 2025 was considered and the Booth Level Officer (BLO) was appointed on 28th June 2025. It further appears that after field verification on 28th June 2025, the application seeking transfer of names moved by the petitioners has been rejected on 2nd July 2025. The present writ petition has been filed on 7th October 2025.

In view of the fact that the application for transfer of names has been considered and rejected after field verification, there shall be a dispute on facts, a serious dispute, which cannot be adjudicated in the present writ proceeding.
