Petitioner challenges order dated 12.11.2025, passed by the revisional authority in an interim stay application thereby rejecting the interim stay application and directing the implementation of the order of the Mamlatdar under Section 5. 3.

The learned counsel for the petitioner submits that petitioner's revision is pending and that an interim order further directing implementation of the order of the Mamlatdar's Court ought not to have been passed.

Considering the above, issue notice to the respondents, returnable on 09.01.2026. The learned AGP accepts notice on behalf of the Respondents / State Authorities.

Till the next date, there shall be interim stay to the order of the Mamlatdar. However, the petitioner undertakes that he would not obstruct 3 to 4 ft. road which is already in existence. 6.

It is also further directed that during the pendency of the present proceedings, the concerned revisional authority may also dispose of the pending revision petition on it's own merits. 7.

Service of notice on the respondents by permissible private modes is also permitted.

In the event, the petitioner fails to serve the respondents on or before the next date, the interim order passed today would stand vacated.

It is clarified that, this order would not come in the way of the revisional authority in deciding the pending revision petition.

Stand over to 09.01.2026.
