The Petitioner raises challenge to the notice dated 22.11.2025 passed by Naib Tahasildar, Kalamnuri, Dist. Hingoli in proceeding No. ROR/Kavi/822, whereby Petitioner and others are directed to remove obstruction from road which passes from survey bandh of Gut Nos. 41, 42 and 43.

Admittedly, learned Tahasildar has passed order dated 08.08.2024 in exercise of powers conferred under Section 143 of the Maharashtra Land Revenue Code and directed that access way from Gut Nos. 41, 42 and 43 to the extent of 9.25 ft. be given to Applicant therein i.e. Respondent No.1 and others. In pursuance to the aforesaid order, notice has been issued by Tahasildar for execution. Admittedly, Petitioner has not 901 WP 14877.2025.odt

challenge the order passed by Tahasildar and same has attained finality. Now execution of order has been undertaken.

In that view of matter, in absence of challenge to order of Tahasildar passed under Section 143 of the Maharashtra Land Revenue Code, there is no reason to entertain Writ Petition against notice of execution of such order.
