The Petitioner challenges the notice dated 27th October, 2025 issued by the Senior Inspector Khadak Police Station, Pune, directing the Petitioner to close his Wine Shop, namely, Jeet Wines with FL-II License No.78 and CL/FL/TOD-III License No.111 licence for a period of three months. It is submitted by the learned counsel for the Petitioner that the notice has been issued by the Senior Police Inspector and the Police Inspector, is not empowered under Section 142 (2) of the Bombay Prohibition Act, 1949 to issue such notice. It is only in case of riot or an unlawful assembly, such notice can be issued.
