The challenge in this petition is to the order passed by the District Magistrate in exercise of powers under Rule 107(11)(vi) (a) of the Maharashtra Co-operative Societies Rules, 1961 ("MCS Rules").

This Court, in the case of Amit Prakash Jori and Anr. v. The State of Maharashtra and Ors. (Writ Petition No. 1331 of 2025), decided on 4 February 2025, has taken the view that the exercise of power by the District Magistrate under the said provision is executionary in nature and that the District Magistrate has no discretion in the matter. In view of the reasons recorded in the said judgment, the present petition is not maintainable. 3.
The writ petition is, therefore, dismissed accordingly. (AMIT BORKAR, J.)
