IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 912 WRIT PETITION NO.15068 OF 2025 RAMESH MAROTI SHINDE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Mr. M.S. Karad, Advocate for petitioner Mr. S.B. Narwade, AGP for respondent Nos.1 to 4 ...

CORAM :

SMT. VIBHA KANKANWADI & HITEN S. VENEGAVKAR, JJ.

DATE :

04th FEBRUARY, 2026 ORDER :

.

Present petition has been filed for direction to Respondent No.3 to decide proposal forwarded by Respondent No.4 on 19.03.2025 for inclusion of name of petitioner in Shalarth ID. Learned AGP waives notice for Respondent Nos.1 to 4 and places on record communication dated 17.04.2025, which is taken on record by marking Exh. 'X'. It is stated that proposal has been submitted belatedly and they should consider the communication dated 28.03.2025 given by Education Officer.

912_WP_15068_2025 It appears that respondent Nos.3 and 4 have not given proper instructions to learned AGP, in view of the fact that in the petition itself we could find the photo copies of the communication dated 23.07.2025 and 06.08.2025 respectively by respondent No.6 to respondent Nos.3 and 4, whereby respondent No.6 has removed the defects, which were quoted in Exh.'X' and, therefore, then we ask learned AGP to take further instructions. Now, learned AGP submits that the fresh documents including the explanation dated 23.07.2025 would be forwarded by respondent No.4 to respondent No.3 within a period of two weeks and thereafter respondent No.2 would decide the said proposal within a period of six weeks. The said statements are now taken as undertaking.

We dispose of writ petition by directing respondent No.4 to forward all the documents included in the proposal dated 19.03.2025 and communications dated 23.07.2025 and 06.08.2025 to respondent No.3 within a period of two weeks and thereafter respondent No.3 to take decision within a period of six weeks thereafter.
