The checkered history of this litigation indicates the bitter fight between two biological brothers, and that too in the presence of their biological mother, who is a widow and is 75 years of age. A single glance at the litigation history between these two would convince any person that both these brothers hate each other and cannot come to terms, out of sheer desire to control the entire educational institutions.

The focal point is a deemed private University and four private Colleges, including one Law College. The reasons for the fight are obvious and need not be discussed. There are 7,000 students admitted in these various Institutions, and the total strength of the Employees is 1,000 plus. The writing is on the wall. These Institutions are likely to hit the downward graph. If the Institutions are to survive, and most importantly, if the students are to be nurtured and the Employees are to be protected, the State Government needs to take a serious and urgent decision as to whether the appointment of an Administrator is necessary. 3.
Smt. Justice Shalini Phansalkar-Joshi, was appointed as the Mediator vide the order of this Court dated 21st November, 2025. The learned Mediator has tendered a report dated 13th January, 2026, in a sealed envelope, which was opened in the Court Hall. The learned Mediator has also mentioned that, despite sincere efforts, the matter could not be settled amicably. The said report is marked as 'Y-1' for identification. Considering Paragraph Nos.6, 7 and 8 of the order of this Court, all the proceedings between the parties were stayed during the pendency of the Mediation, only to facilitate a free and fair participation and to enable the learned Mediator to attempt
an amicable settlement. The Mediation has failed on 13th January, 2026. Needless to state, now the embargo on the various pending proceedings stands lifted with effect from 13th January, 2026. 4.
We, therefore, call upon the learned AGP to suggest few names of Senior Officers from the Department of Education, who can be considered for the appointment of an Administrator for all these Institutions. This is merely a suggestion, in order to let the learned AGP take instructions and be ready to assist the Court if things come to that pass.

List this Writ Petition along with Interim Application No.12533 of 2025, Contempt Petition No.677 of 2025, Interim Application (Stamp) No.121 of 2026, Interim Application (Stamp) No.139 of 2026, Writ Petition (Stamp) No.283 of 2026 and Writ Petition No.15152 of 2025, on 7th March, 2026 at 03:00 pm.
