LATA SUNIL PANJWANI Heard Mr. Butala, the learned counsel appearing for the Petitioner and learned Senior Advocate Chawan appearing for Respondent Nos.6 and7. Also heard Mr. Walimbe, the learned AGP appearing for the State.

The Petitioner in this petition prays for following substantive reliefs:

(a) Issue a Writ of Mandamus or Writ in the nature of Mandamus or any other appropriate writ, direction or order directing the Respondents to forthwith update the revenue records including 7/12, Akarband Patrak, Mojni, Pot Hissa Mojni, Kami Jast Patrak of acquiredGaramond Classico portion and non-acquired portion of Gut No.95/1.

(b) Issue a Writ of Mandamus or Writ in the nature of Mandamus directing the Respondents to properly ascertain and demarcate the boundaries of the acquired portion of the subject land in the revenue records within a specified time frame.

The learned counsel for the Petitioner submits that the Petitioner is willing to make a fresh application to the Sub-Divisional Officer, Thane, MIDC as well as Superintendent of Land Records, Thane for updating the revenue records including 7/12, Akarband Patrak, Mojni, Pot Hissa Mojni, Kami Jast Patrak of acquired portion and non-acquired portion of Gut No.95/1. The learned counsel for the Petitioner submitted that though the map was prepared, the survey of the acquired portion has been carried out recently. 4.

Since the land has already been acquired, undoubtedly, the 2 /3

Respondents have to update the revenue records in respect of the acquired portion and non-acquired portion of Gut No.95/1. Moreover, the Respondents have to properly assess the demarcated boundary of the acquired portion in the revenue record expeditiously. In such view of the matter, if an application is made to the authorities referred to here-in-above, we direct the aforesaid authorities to take a decision on such application for the purpose of updating the revenue records and properly assess the demarcation of the boundaries of the acquired portion of the subject land in the revenue records as expeditiously as possible and in any event within a period of 3 months from the date of making of the application. 5.

The learned counsel for the Petitioner assures that all the necessary documents i.e. the map, the survey reports, revenue records available shall be enclosed along with such an application, to be preferred.
