By this Writ Petition the Petitioner is impugning the order dated 10th November 2025 passed by Debts Recovery Appellate Tribunal (DRAT) in Interim Application No. 695 of 2025 in Miscellaneous Appeal (D) No. 1383 of 2025.

Mr. Soman, learned Counsel appearing for the Petitioner states that though the DRAT order has been impugned in the present Petition, the order has not been made available to the parties. He has accordingly sought for possession which is scheduled to be taken by the Court Commissioner of Respondent - Bank tomorrow to be deferred.

We have considered the prayers in the Petition as well as noted the fact that the possession is scheduled to be taken tomorrow i.e. on 12th November 2025 by the Court Commissioner of Respondent - Bank as also stated by the learned Counsel for the Respondent - Bank. 4.

The DRAT is directed to provide copies of the order dated 10th November 2025 to the parties. This shall be made available by 14th November 2025.

The Court Commissioner of Respondent - Bank is restrained from taking possession of the secured asset for a period of two weeks from today.

The liberty is granted to the Petitioner to file Draft Amendment to the Petition once the said order of the DRAT is made available. 7.

The Writ Petition shall be placed for amendment on 18th November 2025.
