Present petition is filed for directions to respondent authorities to consider the claim of petitioners with regard to rental compensation of their acquired lands and to pay rental compensation to petitioners from the date of taking possession i.e. 15.11.2010 till the date of passing of Award i.e. 17.08.2023. The petitioners state that their land came to be acquired by way of private negotiations on 15.11.2010 and the compensation for the same was disbursed. Therefore, they were entitled for rental compensation for the interregnum period between these two dates. The petitioners, therefore, have filed representations to the authorities requesting to pay the rental compensation to them and if required provide an opportunity of hearing as

25_WP_15260_2025 per the law laid down by the Hon'ble Apex Court in State of Maharashtra vs. Kailas Shiva Rangari [2016 (4) ALL M.R. 513 (FB)]. The learned AGP appearing for respondent authorities makes a statement that the representation of each of the petitioners will be decided by the authority within a period of eight weeks from today. The statement is accepted.

Exh. 'B' on page No.29 of the petition annexes the document showing the entitlement of petitioners to get rental compensation, however, the only exercise that is required to be performed is to calculate the amount of rental compensation for each of the petitioners and the interest amount to be paid thereupon.

Accordingly, we direct the petitioners to file fresh applications with all necessary documents to the office of respondent No.1 and upon receipt of it, respondent No.1 will decide the said applications within a period of eight weeks thereafter. Accordingly, the writ petition stands disposed of.
