In this Writ Petition, the grievance raised is that the tribe certificate issued to the Petitioner of belonging to Koli-Mahadev Scheduled Tribe was tried to be submitted before the Caste Scrutiny Committee for its verification. However, the Committee insisted that the petitioner should submit the tribe certificate in Form 'C' postulated under the Maharashtra Act No. XXIII of 2001. The Petitioner accordingly requested the Respondent/Sub Divisional Officer, Majalgaon, Dist. Beed, to issue the caste certificate in Form 'C' as contemplated under the Maharashtra Act No. XXIII of 2001. However, the same has not been issued and, therefore, this Writ Petition.

After hearing the parties, we are of the considered view that the prayer made in the Writ Petition is reasonable and capable of being granted. Therefore, we pass the following order :-

ORDER

(i) The Respondent/Sub-Divisional Officer, Majalgaon, Dist. Beed is directed to issue corrected tribe certificate in form 'C' in favour of the Petitioner to be belonging to Koli-Mahadev Scheduled Tribe within a period of one month from today, subject to Petitioner surrendering the original tribe certificate which is in incorrect form.

(ii) We also make it clear that, if the earlier tribe certificate of the Petitioner is surrendered before the Respondent/Sub-Divisional Officer, before issuing corrected tribe certificate in Form 'C' he should also test the genuineness of issuance of earlier tribe certificate.

(iii) Writ Petition stands disposed of.
