1] By the present petition, the petitioner challenges the order passed by the authorities constituted under the Mamlatdars' Courts Act, directing the petitioners to remove obstructions from the road of the respondents. 2] The respondent no.2 i.e. Tahsildar, by order dated 10.04.2023, allowed the application field by the respondent no.1 and directed the respondent no.4 and petitioner not to obstruct the respondent no.3 from using the road from Survey Nos.289 and 291. The Revisional Authority has confirmed the said order under Section 23 of
15383.25WP the Mamlatdars' Courts Act. It is informed that the civil suit is filed, challenging the order of the Mamlatdar in which injunction is refused by the Civil Court. Considering the same, no case is made for interference. Hence, the present Writ Petition is dismissed. However, liberty is granted to the petitioner to pursue the appellate remedy before the Civil Court.
