On 4th November 2025, a Schedule for Municipal Elections was published by the State Election Commission.

According to Mr. Vaibhav R. Gaikwad, the learned counsel for the petitioner, this writ petition was filed on 5th November 2025 at Circuit Bench of this Court at Kolhapur and has been transferred to the Principal Seat at High Court of Bombay by an order dated 7th November 2025.

Mrs. Neha Bhide, the learned State counsel raised an objection that a copy of the petition has not been served upon her. The learned counsel for the petitioner states that the petitioner's name was included in the voters list prepared for the legislative assembly held bgp Page | 1

14.15447.25-wp.docx in October 2024 and, in support thereto, he has produced a copy of the voters list and his voter identity card. This is the case set-up by the petitioner that vide corrigendum dated 16th July 2025 it was provided that the voters list for the legislative assembly shall be considered for the elections of local body and no new name shall be included or deleted from the voters list.

The grievance of the petitioner is that in the final voters list published on 31st October 2025 his name is not included. According to the petitioner, he made an application on 3rd November 2025 for inclusion of his name in the voters list and visited the office of State Election Commission and had personal interaction with him but no decision was taken by the State Election Commission. 5.

This matter was taken up around 1:15 pm today and the learned counsel for the petitioner informed the Court that by 3:00 pm. the petitioner can submit his nomination form. Just to indicate, the matter was not even mentioned in the morning when the Court had assembled and at this last moment when a copy of petition is not even served to the learned State Counsel, we are not inclined to pass any interim order in favour of the petitioner. 6.
