Heard the learned Counsel for the petitioner. 2.

A limited prayer in this petition is to hear and decide Notice of Motion No.3780 of 2023 taken out by the plaintiff in Suit No.2411 of 2023.

Upon the perusal of the roznama of the proceeding, it appears that the Notice of Motion was heard in the month of May, 2025 and, thereafter, it was adjourned for submissions in rejoinder. Subsequently, the learned Counsel for the petitioner informs the Court that, the suit came to be assigned to another learned Judge.

The suit is now posted for hearing on 6th February, 2025. 1/2

Since the Notice of Motion was substantially heard in the month of May, 2025, the prayer for expeditious hearing and disposal of the Notice of Motion appears justifiable. 6.

The learned Judge seized with Notice of Motion No.3780 of 2023 in Suit No.2411 of 2023 is requested to prepone the hearing in Notice of Motion No.3780 of 2023 to 5th January, 2026.

The learned Judge, City Civil Court, is requested to hear and decide the Notice of Motion, as expeditiously as possible and, preferably, within a period of three months from 5th January, 2026.

Petition stands disposed.
