1) Challenge in the Petitions is to the order dated 13 October 2025 passed by the Divisional Joint Registrar, Co-operative Societies, Konkan Division, Navi Mumbai (Divisional Joint Registrar) partly allowing Revision Application No.90 of 2025 and remanding the proceedings to Page No.

Megha 52& 53_wp_15526 & 15527_25 the Deputy Registrar, Co-operative Societies, (Deputy Registrar )for fresh decision.

2) It appears that the Deputy Registrar had passed order of disqualification of the contesting Respondents essentially on the ground of delay in filing the rectification report. The Divisional Joint Registrar has taken into consideration the ratio of the judgment of this Court in which it is repeatedly held that minor lapses of compliance, especially those relating to procedural or clerical defaults, cannot be equated to misconduct warranting disqualification.

3) This Court is not inclined to interfere in the impugned order since the impugned order merely directs remand of proceedings for fresh decision by the Deputy Registrar. In the remanded proceedings, both the parties would be at liberty to raise their respective contentions before the Deputy Registrar, who shall proceed to decide the same on their own merits, without being influenced by the earlier order dated 17 April 2025 or by the order passed by the Divisional Joint Registrar dated 13 October 2025. Leaving open all the rights and contentions of the parties, the Writ Petitions are disposed of.
