Heard the learned advocate Mr. Parikshit Mantri holding for learned advocate Mr. P.V. Barde for the petitioner. The petitioner's advocate is submitting that the entry in the service was not from disabled category. According to the petitioner, he incurred disability due to accident. Earlier also, he had filed disability certificates as directed by respondents No.4 and 6. He makes a categorical statement that the petitioner has no intention to seek benefits on the basis of disability certificate.

In view of the aforesaid statement, the petitioner is directed to file an affidavit to that effect on or before 17.01.2026.

Till then, impugned communication dated 11.12.2025, for the petitioner, issued by respondent No.5 is stayed. 4.

We make it clear that if affidavit is not filed or it is seen that the petitioner had not informed about the disability to the employer or has taken any benefit representing him to be disabled, then we may modify our order.

Issue notice to respondents. Learned AGP waives service of notice for respondents No.1 to 3. Learned advocate Mr. Avinash Aghav waives service of notice for respondents No.4 and 5. 6.
