The petitioners applied for the post of Assistant Professor (Applied Arts) in response to the advertisement dated 13.09.2023 published by the Maharashtra Public Service Commission (in short 'MP.SC'). The recruitment process was taken to logical end. Initially, the names of the petitioners figured in the list of eligible candidates while, the names of some of the respondents initially figured in the list of ineligible candidates. The respondent/MPSC later on, recommended
2 916,934.doc the names of private respondents for the said posts. Since, the matter is sub-judice before the M.A.T., we do not propose to make any observations as to the merits of the matter, that too when the private respondents are not before us now.

It is informed by the learned Advocate for the petitioners that, two posts have remained unfilled since, no suitable candidates were found. The communication dated 17.10.2025 issued by the M.P.S.C. has been adverted to in that regard. The learned A.G.P. therefore, on instructions, informs that, on completion of the recruitment process, the M.P.S.C. recommended the names of candidates for filling up the vacancies advertised. As per the communication issued way back in October 2025, two posts of Assistant Professor (Applied Arts) are shown to have remained unfilled since, no eligible candidates were found. According to learned A.G.P., it is the call of the respondent/State as to how the vacant posts are to be filled up. Role of M.P.S.C. is only recommendatory.
For filling up vacant posts, the State Government is required to make a requisition for initiation of the recruitment process. As of now, two posts of Assistant Professor (Applied Arts) are vacant. The petitioners are two in number. Their Original Applications are yet to be decided by the M.A.T. on its own merits. As and when the respondent-State or the M.P.S.C., is likely to recommend the names for filing up those two posts, the petitioners can very much revive their prayers before the M.A.T., for keeping those two posts vacant/unfilled until their claim in Original Applications are decided. 4.
With this observations, the Writ Petitions stand disposed of.

We expect the M.A.T. to decide the Original Applications within a time frame of 12 months from the date of receipt of a copy of this order.
