We have heard the learned Senior Advocate on behalf of the Petitioners and the learned Advocate on behalf of the RespondentZilla Parishad, for a long time. We have perused the Judgment delivered by this Court dated 14th November, 2025 in Writ Petition No. 5456 of 2025 and connected matters.

We are informed that all these Petitioners have already preferred their appeals before the Divisional Commissioner in the light Talwalkar

930.WP15656.2025.odt of the Government Resolution dated 18.6.2024. 3.

In view of the above, as the Appeals have been preferred, we would expect the Divisional Commissioner to deal with the Appeals on their own merits and pass reasoned orders. The Divisional Commissioner would segregate those Appeals filed by the Teachers who are aged 53 plus and, in the light of the Judgment of this Court dated 14th November, 2025 (supra), consider as to whether they have been transferred to the difficult areas. In the event, they have crossed 53 years of age and are transferred to difficult areas, the Divisional Commissioner would consider their cases in accordance with the policy of the State Government and pass appropriate orders.

In the event of any person falling in the specially abled category and is suffering from a grave and serious illness, not of the type of Angioplasty, BP, Sugar, Anemia, Insomnia, thyroid, etc., their cases would be considered in accordance with all such categories stated in the Government Resolution.
