The Writ Petition has been placed today in view of statement made by Court Commissioner Mr. Ganesh Dadasaheb Thombare that he will issue possession notice and take physical possession of the secured asset. 2.

The grievance made by Mr. Thombare on the previous date was that the Respondent No. 8 - Versova Police Station was not providing police ---------------------------------------------------------------------------------------------------------------------------------------------------------------------------------

assistance for taking physical possession of the secured asset. 3.

The learned AGP appearing on behalf of Respondent No. 8 - Senior Police Officer (SPO), Versova Police Station states on instructions of the Senior Police Officer who is present in Court that Police assistance will be provided to the Court Commissioner - Mr. Thombare for taking physical possession on the date scheduled for taking the same. 4.

The Court Commissioner - Mr. Thombare states that possession notice will be issued on 26th December 2025 for taking physical possession of the secured asset on 19th January 2026. The statement is accepted. 5.

In view of the above statement, the Court Commissioner - Mr. Thombare shall with Police assistance of Versova Police Station take physical possession of the secured asset on the scheduled date i.e. 19th January 2026. 6.

This order is without prejudice to the rights and contentions of the Applicant in Securitization Application No. 230 of 2024 filed in the DRT, Mumbai.

Applicant in Securitization Application No. 230 of 2024 shall ---------------------------------------------------------------------------------------------------------------------------------------------------------------------------------

give two prior working days notice to the Petitioner in the event of moving the Application.
