Heard the learned Counsel for the petitioner. 2.

The challenge in this petition is to an order passed by the Maintenance Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

In view of the Division Bench judgment of this Court in the case of Jagdish Pitambar Pawar vs. Pitambar Pundalik Pawar1 an appeal is maintainable at the instance of the children against an order passed by the Maintenance Tribunal. 4.

The petition stands disposed with liberty to the petitioner to file an appeal before the Appellate Authority. WP/36/2023 Aurangabad Bench of High Court at Bombay, dated 29/11/2023. 1/2

In the event an appeal is filed by the petitioner before the Appellate Authority, within a period of one week, alongwith an application for interim relief, the Appellate Authority is requested to decide the application for interim relief as expeditiously as possible.
