This Petition under Article 226 of the Constitution of India filed praying for following substantive reliefs:

a) That this Hon'ble Court may be pleased to issue an appropriate Writ or Order, Award, and/or Direction and be pleased to direct the Respondent No.5 to decide the Application dated 24/09/2025 filed by the Petitioner;

(b) That this Hon'ble Court may be pleased to issue an appropriate Writ or Order, Award, and/or Direction and be pleased to direct the Respondent No.4 to decide the Application dated 25/09/2025 filed by the Petitioner;

(c) Pending the hearing and final disposal of the present Writ Petition, the permission dated 13/9/2022 granted for construction by the Respondent No 5 may kindly be stayed;

((d) Ad-interim relief in terms of prayer clause (c) above may kindly be granted;

(e) Any other just and equitable Order in the interest justice and in the facts and circumstances of the above be granted; Mane

After the Petition was heard for some time, learned Advocate Mr.Khaire, for the Petitioner fairly states that the Petitioner would withdraw this Petition with liberty to the Petitioner to file the Civil Suit. Allowed to be withdrawn with liberty as prayed for.

Disposed of as withdrawn. No costs.
