We have heard the learned Advocates for the respective sides. 2.

The issue pertains to the termination of a compassionate appointee after seven years of his appointment on a compassionate basis, without being given an opportunity of hearing, and solely on the ground that the Petitioner's name was substituted seven years ago in place of his mother, and prior permission was not taken.

The above issue is well settled in Dnyaneshwar s/o. Ramkishan Musane vs. State of Maharashtra and others, 2020 (5) Mh.L.J. 381 and Kalpana Vilas Taram and another v. State of Maharashtra and others, (FULL BENCH) 2024 (4) ABR 534 and AIR Online 2024 BOM 682.

The learned Advocate for the Zilla Parishad sought a pass over to take instructions. After the matter was called out, he submits, on instructions, that the impugned order dated 15th September, 2025 stands recalled.
