We have considered the submissions of the learned Advocate, Ms. Ayyappan for the Petitioner and the learned Additional G.P. on behalf of the State.

The learned Advocate, Ms. Ayyappan submits that the Petitioner is identically placed as like the Petitioners in cases of Madhukar s/o Bhavanrao Sadgir V/s. State of Maharashtra and others, 2019(2) Mh.L.J. 119 and Sandip Ganpat Hadbal & Ors. V/s. The State of Maharashtra & Ors. (Order dated 29th November, 2024, passed by this Court on Interim Application No.1418 of 2024 in Writ Petition No.13177 of 2023).

The Review Application (St) No.24678 of 2019 along with other Review Applications filed by the State, in Madhukar s/o Bhavanrao Sadgir (supra), were rejected by order dated 20th September, 2019. The State approached the Hon'ble Supreme Court in Special Leave Petition (Civil) Dairy No(s). 12338 of 2020 and group of SLPs (The State of Maharashtra & Ors. Etc. V/s. Madhukar & Ors. Etc.). By order dated 20th August, 2020, all the SLPs have been dismissed. Thereafter, insofar as parity in wages is concerned, this Court has delivered a Judgment in Sandip Ganpat Hadbal & Ors. (supra), granting such parity in wages. 4.

In view of the above, this Writ Petition is disposed off in terms of Madhukar s/o Bhavanrao Sadgir (supra) and Sandip Ganpat Hadbal & Ors. (supra). Needless to state, the Respondent/State would be at liberty to carry out a verification exercise and consider as to which of these Petitioners are actually covered by the law laid down in Madhukar s/o Bhavanrao Sadgir (supra) and Sandip Ganpat Hadbal & Ors. (supra). Let such verification exercise be completed within a period of 45 days from today. Those who are covered by the afore stated law, would be extended such benefits as are made available to identically placed employees, within a period of 45 days thereafter. [HITEN S.
