In this petition, the petitioner seeks the following reliefs: "(a) This Hon'ble Court may be pleased to issue a writ of certiorari or any other appropriate writ, order or direction calling for the records of the tender process and quash and set aside the impugned E-tender ID-2025_PMCP_1205614_1 dated 31/07/2025 issued by the respondent no.1 for outsourcing of public cleanliness and sanitation works under the jurisdiction of the Hadapsar-Mundhawa.
(b) This Hon'ble Court may be pleased to issue a writ of mandamus or appropriate direction directing the respondent no.1 to reissue the said E-tender with inclusion of the earlier affidavit condition no.31 as mentioned in the earlier Tender Notice dated 23/04/2025.
(c) This Hon'ble Court may be pleased to declare the respondent no.8 as illegal/non-qualified bidder and petitioner be held as L-1 Bidder and accordingly respondent be directed to issue work order in favour of the petitioner.
(d) That this Hon'ble Court be pleased to issue any appropriate writ/direction/order and thereby be pleased to call for explanation from the respondent nos.2 to 7 as to what steps and actions were taken as against the respondent no.8 when it came to knowledge that there are criminal cases which are filed against the respondent no.8 and after considering the said explanation of the respondent nos.2 to 7, appropriate 1/2 105-WP-16139-2025.doc Dixit
order including taking actions as against the respondent nos.2 to 7 be passed in the interest of justice. (e) Pending the hearing and final disposal of the present petition, respondents be restrained from issuing any work order or entering into a contract in pursuance of the work order with respect to the e-tender ID-2025_PMCP_1205614_1 dated 31/07/2025 for outsourcing of public cleanliness and sanitation works under the jurisdiction of the HadapsarMundhawa. (f) Pending the hearing and final disposal of the present petition, the necessary explanation be called for from the respondent nos.2 to 7 including respondent no.8 and till htat no work order to be allotted to the respondent no.8.
(g) Interim/ad-interim relief in terms of prayer clause (d) above." 2.
Mr. Sachin Pawar, the learned counsel for the petitioner tenders a copy of the letter dated 1st December 2025 received from the petitioner-company stating that the petitioner is not interested in prosecuting this matter and seeks leave to withdraw this petition. The said letter is taken on record. 3.
In view of the above, Writ Petition No.16139 of 2025 is dismissed as withdrawn.
