Heard the learned Counsel for the parties.

The petitioner is aggrieved by an order passed by the learned District Judge, Belapur in Commercial Suit No. 05/2025, whereby the learned District Judge declined to take application for interim relief on board and directed that the suit be heard on the pre-scheduled date i.e. 29th November, 2025. 3.

It appears that, the defendant/respondent herein has filed by SANTOSH SUBHASH KULKARNI Date: 2025.12.03 20:28:45 +0530 SANTOSH SUBHASH KULKARNI an application under Section 8 of the Arbitration & Conciliation Act seeking reference of the dispute to the Arbitrator. 1/2

In these circumstances, the suit has now been adjourned to 28th December, 2025.

The learned District Judge is requested to hear and decide the application for reference of the dispute under Section 8 of the Arbitration & Conciliation Act as expeditiously as possible, and, in the event, it is not possible to decide the said application under Section 8, expeditiously, the application for interim relief be also heard simultaneously.

The petition stands disposed.

All contentions of all the parties are kept open for consideration.
