Heard the learned Counsel for the Petitioner. 2.

The Petitioner, being aggrieved by an order dated 10th October 2025, passed by the Divisional Commissioner, Pune, under Section 39 of the Maharashtra Village Panchayats Act, 1959 ("the Act, 1959"), has preferred an Appeal under Section 39(3) of the Act, 1959, before the State Government.

As the Application for stay preferred by the Petitioner, has not been heard by the State Government, the Petitioner has approached this Court.

Since, the Petitioner has already availed statutory remedy, it may not be expedient to entertain the Petition.

The State Government is directed to hear and decide the Appeal preferred by the Petitioner expeditiously, and, if it is not possible to hear and decide the Appeal finally, the Application for stay be heard and decided.

6.

For the said purpose, the said Application be taken up for hearing before the State Government on 15th December 2025. 7.

An appropriate order on the said Application be passed within a period of two weeks, thereafter.

Petition disposed.
