This petition takes exception to the order dated 5th December 2024 passed by the Family Court, Pune below Exhibit12 in P.A. No. 1308 of 2022. By the order impugned, the learned Family Court has directed the petitioner-husband to pay the interim maintenance at the rate of Rs.24,000/- per month to the respondent -wife.

Learned counsel for the petitioner submits that a specific plea was raised that respondent/wife is gainfully employed. It is submitted that the respondent/wife has not denied the said fact by filing appropriate affidavit. It is submitted that the learned Family Court thus erred in allowing the application filed by respondent/wife for interim maintenance.

I have perused the impugned order. Though I am not inclined to interfere with the order impugned, however, the trial/executing Dinesh S. Sherla 1/2
14-cwp-16217-25.odt Court shall not take any coercive action pursuant to impugned order unless the affidavit is filed by the respondent/wife that she is not gainfully employed.
