In this petition, the petitioner seeks the following reliefs: "(a) This Hon'ble Court may be pleased to issue a writ of certiorari or any other appropriate writ, order or direction calling for the records of the tender process and quash and set aside the impugned E-tender ID-2025_PMCP_1198561_1 dated 26/07/2025 issued by the respondent no.2 for outsourcing of public cleanliness and sanitation works under the jurisdiction of the Bibwewadi, Pune.

(b) This Hon'ble Court may be pleased to issue a writ of mandamus or appropriate direction directing the respondent no.1 to quash and set aside the entire tender process for impugned E-tender ID-2025_PMCP_1198561_1 dated 26/07/2025 as the terms and conditions of the tender are not followed and are bypass and the bidders who are not entitle to participate in the said tender are qualified and are permitted to participate.

(c) This Hon'ble Court may be pleased to declare the respondent nos.9 to 13 as illegal/non-qualified bidder and petitioner be held as L-1 Bidder and accordingly respondent nos.2 to 6 be directed to issue work order in favour of the petitioner. (d) That this Hon'ble Court be pleased to issue any appropriate writ/direction/order and thereby be pleased to call for explanation from the respondent nos.2 to 6 as to what steps and actions were taken by them in respect of the 1/2 107-WP-16239-2025.doc Dixit

representation/letter given by the petitioner and after considering the said explanation, the respondent nos.2 to 6 be held responsible for the said illegal act and appropriate order including taking actions as against the respondent nos.2 to 6 be passed in the interest of justice. (e) That this Hon'ble Court be pleased to issue any appropriate writ/direction/order and thereby be pleased to direct the respondent nos.2 to 6 to decide the said representation/letter dated 24/09/2025 and 13/10/2025 given by the petitioner to the respondent no.4 and thereby pass an appropriate order on the said representation after hearing all necessary parties.

(f) Pending the hearing and final disposal of the present petition, this Hon'ble Court be pleased to stay the tender process of Etender ID-2025_PMCP_1198561_1 dated 26/07/2025 for outsourcing of public cleanliness and sanitation works under the jurisdiction of the Bibwewadi, Pune and no further process be initiated and the respondent nos.2 to 6 be restrained from passing any order or opening the financial bid or from giving any Work Order in respect of the said tender.

(g) Pending the hearing and final disposal of the present petition, this Hon'ble Court be pleased to direct the respondent nos.2 to 6 to consider the said representation letter dated 23/09/2025, 24/09/2025 and 13/10/2025 and after considering the documents and hearing all necessary parties appropriate order kindly be passed.

(h) Pending the hearing and final disposal of the present petition, the necessary explanation be called for from the respondent nos.2 to 6 including respondent nos.9 to 13 and after considering the said explanation, appropriate actions be initiated against all responsible for the alleged loss to Pune Municipal Corporation.

(i) Interim/ad-interim relief in terms of prayer clauses (e) to (g) above."

Mr. Sachin Pawar, the learned counsel for the petitioner tenders a copy of the letter dated 1st December 2025 received from the petitioner-company stating that the petitioner is not interested in prosecuting this matter and seeks leave to withdraw this petition. The said letter is taken on record. 3.

In view of the above, Writ Petition No.16239 of 2025 is dismissed as withdrawn.
