Heard the learned Counsel for the petitioner. 2.

The challenge in this petition is to an order dated 14th October, 2025 passed by the learned District Judge-4, Kalyan staying the effect and operation of the order passed by the Executing Court to the extent of 50% share of the Respondent No. 1/Objector.

Having regard to the nature of the order and the facts of the case, this Court does not consider it expedient to entertain the petition. However, since the petitioner has already sold the subject property by auction sale, it would be appropriate that the District Judge decides the Miscellaneous Civil Appeal 1/2

35 WP 16314.25.DOC 28/2025 as expeditiously as possible and, preferably, within a period of four months from the next scheduled date of the Miscellaneous Civil Appeal.
