After the Court expressed its disinclination to entertain the Petition, the learned Counsel for the Petitioner seeks leave to withdraw the Petition with liberty to institute a suit before the trial Court to assert the easementary rights. 3.

Leave granted with liberty as prayed for.

The Writ Petition stands disposed as withdrawn. 5.

In the event, the Petitioner files a suit, the Civil Court is requested to decide the same on its own merits and in accordance with law, without being influenced by any of the observations made by the revisional authority in the impugned order.
