The learned Advocate representing Respondent No.2 Corporation has tendered a short additional affidavit in reply (pages 351 to 355). The TAC Report dated 13th January, 2026 is at page no.352 and the conclusion indicates that the Writ structure falls in the 'C-1' category.

In view of the above, the learned Advocate for the Petitioner submits that this Petition may be disposed off in the light of the judgment of this Court in Writ Petition No.9996 of 2025 (Pushpanjali Co-op. Hsg. Society Ltd. v/s. Vasai Virar City Gauri Gaekwad

30.WP-16395-2025.odt Municipal Corporation & Ors.), delivered on 21st August, 2025. 3.

As such, the Municipal Corporation shall follow the dictum set out in Pushpanjali Co-op. Hsg. Society Ltd. (supra) and act with promptitude by following the due procedure laid down in law.
