Mr. Sandeep Mishra a/w Ms. Madhura Mulay, Advocate for the Petitioner.
Mrs. Chaitrali Deshmukh, Advocate for the Respondents CORAM : RAVINDRA V. GHUGE & ASHWIN D. BHOBE, JJ.
DATE : 3rd DECEMBER, 2025 P.C. :- 1.
The learned Advocate for the Corporation has taken instructions and submits that the notice dated 14th November, 2025 is only to call upon the Petitioner to tender an explanation and after the details are submitted, a hearing would be caused on the notice. Thereafter, all contentions of the Petitioner and the documents which are produced, would be considered and a reasoned order dealing with all his contentions would be passed. This exercise would be completed within a period of 45 days. It is further
submitted that the Petitioner can tender a detailed reply along with all the documents raising all grounds within a period of 15 days. 2.
The above statements are recorded and the learned Advocate for the Petitioner is agreeable. He submits that the explanation, by raising all the grounds and placing all documents on record, would be tendered within 15 days from today. Thereafter, the Corporation would follow the due procedure, give a reasonable opportunity of hearing to the Petitioner and pass a reasoned order dealing with all the grounds raised by the Petitioner and the documents cited. Thereafter, the Petitioner would be at liberty to avail of a remedy as is permissible in law. Let the order be passed, on or before 20th January, 2026 and the order be communicated to the Petitioner on his following What's App Number within 48 hours of the passing of the order :- 9594940131 / 9969451379.
3.
The learned Advocate for the Corporation further contends that the Petitioner's structure is on a Government land. An infrastructure project (A Public Project) is already underway and the Petitioner's structure is turning out to be an obstacle. The Petitioner
denies these contentions. Since we are informed that it is a Government land, the Petitioner will first establish his right, title and interest in the property with the aid of the statutory documents. 4.
With the above directions, this Writ Petition is disposed off.
