ORDER :

Mr. Alaspurkar, the learned AGP appearing for the Respondent - State has tendered two letters dated 15th December, 2025 from the Respondent No.2 - Superintendent, Chief Judicial Magistrate, Raigad - Alibag, addressed to the learned AGP. The said letters are taken on record and marked 'X' collectively for identification.

In the first letter dated 15th December, 2025, it is stated
that in so far as the Criminal Miscellaneous Application No.1671 of 2024 referred to in the table at prayer Clause (c) of the Petition, the matter is reserved for Orders on 30th December, 2025. In so far as Criminal Miscellaneous Applications listed at Sr. Nos.2 and 3 in the table at prayer Clause (c) of the Petition are concerned, the name of the Complainant / Applicant therein viz. Shriram Housing Finance Ltd. has changed to Truhome Finance Ltd. The Advocate for the Complainant / Applicant therein has assured the Court that he will file certificate showing that Shriram Housing Finance Ltd. has changed its name to Truhome Finance Ltd. on the next date. Although the arguments have been heard in both Criminal Miscellaneous Applications, the matters have been stood over for compliance to 30th December, 2025.

By the second letter dated 15th December, 2025, in so far as Criminal Miscellaneous Application No.793 of 2025 is concerned, the matter is scheduled for arguments on 19th December, 2025 and it is stated in the said letter that, if the arguments are advanced on that date, the matter is likely to be disposed of within a
period of 10 days thereafter.

The learned AGP has submitted that as per the said letters, orders in the four Criminal Miscellaneous Applications for which the present Writ Petition has been filed will be passed by 30th December, 2025.

We accordingly direct the Respondent No.2 - Superintendent of Chief Judicial Magistrate, Raigad - Alibag to ensure that the Orders are passed by the concerned Magistrate Courts under Section 14 of the SARFAESI Act, 2002 in the four Criminal Miscellaneous Applications by 30th December, 2025. 6.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
