No one appears for the petitioner when the writ petition was called out yesterday. Even today also no one appears for the petitioner.

Raising a serious objection to the prayer made in this writ petition that the votes of the respondent nos.7 and 8 in the elections for Sarpanch held on 2nd July 2025 be declared void ab initio. Mr.Sachindra B. Shetye, the learned counsel for the State Election Commission and Mrs. Neha S. Bhide, the learned Government Pleader would submit that such a plea can be raised in an election petition to challenge the election of the successful candidate. 3.

It is settled law, as held by the Hon'ble Supreme Court in "Boddula Krishnaiah v. State Election Commr., A.P." (1996) 3 SCC 416, Article 243-O operates as a constitutional bar on interference with election process except by an election petition.

In the light of the same, the interference of this Court under Article 226 of the Constitution of India is not warranted. Writ Petition No. 16653 of 2025 is dismissed.
