By the order dated 2nd December, 2025, passed in Writ Petition No. 11473 of 2025, filed by the present Petitioner, the learned Single Judge has directed the Appellate Authority to decide the pending Appeal within two weeks from the date of appearance of the parties, by fixing today i.e. 15th December, 2025, as the date of appearance. The Petitioner has preferred this Appeal under Section 152 of the Maharashtra Co-operative Societies Act. The direction of the learned Single Judge is for disposal of the said Appeal.

Ms. Chandnani, learned Counsel appearing for the Petitioner submits that due to absence of any interim order of protection, the Petitioner apprehends that even before the Appeal is considered on REKHA PRAKASH PATIL REKHA PRAKASH PATIL Date: 2025.12.16 18:44:59 +0530 15th December, 2025
32-WP-16887-2025.DOC merit, the impugned Notice dated 20th November, 2025, directing attachment of Petitioner's property may be executed, in which event, the Appeal itself would become infructuous. 3.
Ms. Bhatia, learned AGP appearing for the State submits, on instruction, that the parties have appeared before the Appellate Authority today and the Appeal would be heard as per the direction issued by the Court. She has also confirmed that no further step has taken for execution of the order of attachment. If that be so, we are of the view that no practical purpose would be served by keeping the Writ Petition pending before this Court any further.

Since the Appellate Authority has began the process of hearing and disposal of the Appeal within the time frame, as provided by the order dated 2nd December, 2025, passed by this Court, we dispose of this Writ Petition with a further direction that till such time, final order is passed by the Appellate Authority in the Appeal preferred by the Petitioner, the effect and operation of the impugned Notice dated 20th November, 2025, shall remained suspended.
