The learned Counsel for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to file Second Appeal, as by the impugned order the learned District Judge has rejected an application for condonation of delay in filing the Appeal against a judgment and decree passed by the Trial Court in Regular Civil Suit No. 1256/2009.

Leave granted with liberty as prayed for.

The time spent by the petitioner in prosecuting this petition may be accounted for, in the event the question of delay in filing the Second Appeal arises, under Section 14 of the Limitation Act.
